uninsured motorist laws in so cal?

my hubby was in a minor accident yesterday afternoon. the women got out of the car and was so upset and couldn't' stop apologizing. she had no clue on how to handle the matter she wanted to walk away from it all which my hubby was ok with however he knew that exchange of information had to be done. today at work he got a phone call from her insurance stating that the women said the hit was my hubby's fault. then asked for our policy number!! my hubby had to call our insurance to get that information and come to find out we haven't had insurance since September. So he is basically now an uninsured motorist. ( we hate our insurance company Travelers always making mistakes) what are the procedures for uninsured motorist involved in a minor accidents with no injuries? thanks for all your help in advance. sorry for the long story i had to let it out some how....although i know i could have gotten to the point a lot sooner...take care all of you

The only good thing here is the police weren't called. Your hubby would have got a ticket and in some areas, the car towed. Probably what will happen is the other party's insurance company will pay and come after you and your hubby to recoup the money. You could agree to pay damage up front. Recognize your hubby is behind the 8 ball as he was illegally (no liability insurance) operating the vehicle. It sucks but your in a lose lose situation. Oh by the way, get some liability insurance.
